EL PASO (AP) — A judge has postponed next week’s scheduled execution of an El Paso man for the fatal beating of his girlfriend’s 19-month-old son.
Attorneys for 40-year-old Rigoberto Avila persuaded state District Judge Anna Perez that they needed more time to investigate possible new evidence in the 2000 killing of Nicholas Macias.
Avila had been set to die by lethal injection April 10 in Huntsville. Perez has rescheduled the punishment for July 10.
